The following points govern your use of the Continuous Improvement Software Suite web-based application ("CSUITE"). We've kept this simple, but it is a legally enforceable agreement between you and Factory Physics, Inc. ("FPI"). Please read it carefully.

Your use of CSUITE may be terminated at any time by you or by FPI.

The features and performance of CSUITE are subject to change at any time.

The availability and response time of CSUITE is affected by factors outside of FPI's control, such as the responsiveness of your computer, your software and conditions on the internet. FPI does not warrant CSUITE's responsiveness or availability.

Your use of CSUITE is restricted to your own company's internal production systems. You may not offer services to other companies using CSUITE. (Please contact us if you would like to offer such services to others). Accredited academic institutions may use CSUITE in the teaching of courses which have adopted the latest edition of the text, Factory Physics, by Wallace J. Hopp and Mark L. Spearman.

CSUITE provides an approximate queueing network model. It is not a complete or wholly accurate simulation of your production system. CSUITE is offered as is, and the entire risk as to satisfactory quality, performance, accuracy and effort is with the user. FPI is not liable for damages of any type (whether direct, indirect, incidental, consequential or other), relating to your use of or inability to use results obtained from CSUITE. This exclusion of liability applies whether damages are foreseeable or unforeseeable and even if FPI is advised of the possibility of such damages.
